Agreement to Conditions for access to SWP Online
- These Conditions apply in relation to the provision of Standard
Work Procedures to Service Providers by ENERGEX. All other terms
and conditions that apply to the relationship between ENERGEX and
its Service
Providers still apply, including any terms and conditions in any
contract the Service Provider has with ENERGEX or the terms and conditions
in
the Quality Assurance Requirements for Suppliers of Services document
(Issue No 7).
- In consideration for access to SWP Online, you accept and agree
to be bound by the Conditions when you click on the "I accept these
terms and conditions" button at the bottom of this screen. If you
do not accept these terms and conditions, or are not authorised to
accept these terms and conditions on behalf of your Service Provider,
click
the "I do not accept" button and you will not be given access
to SWP Online.
- These conditions may change at any time. If these conditions change
you will be required to accept the new conditions the next time you
log on to SWP Online.
- You acknowledge that access to SWP Online may be terminated at
anytime should the relationship of ENERGEX and the Service Provider
be terminated.
- ENERGEX may at any time choose to cease providing access to SWP
Online and provide access to the Standard Work Procedures by some
other means.
- These Conditions and use of SWP Online are governed by the laws of Queensland, Australia. Any claim relating to the use of SWP Online will be heard by the Queensland Courts.
Secure Access
- You will be given a username and password ("personal id").
You agree that you will:
- securely store the personal id and not show, tell
or otherwise make it available to anyone;
- not record any part of the personal id on or near any electronic
device used to access the internet;
- ensure that you and any other person using a personal id is authorised
by your Service Provider to access SWP Online (regardless of that
person's actual identity) and will comply with the Conditions.
- give ENERGEX such information as ENERGEX requests from time to
time in respect of access to SWP Online by a Subscriber or by any
other person;
and
- immediately notify ENERGEX on becoming aware of, or suspecting,
unauthorised access to SWP Online.
- ENERGEX is not liable for any losses, costs, expenses, claims,
damages and liability which may be suffered by you, or any other
party, as a result of any access to, or use of, SWP Online by an
unauthorised person using your personal id.
- ENERGEX is not responsible for the operation of any computer or
communication system (other than its systems) that you use to access
SWP Online. ENERGEX is not responsible for delays, errors, inaccuracies
or omissions due to a failure of a computer system or ancillary equipment,
or due to any other circumstances beyond the control of ENERGEX.
Electronic Provision of Standard Work Procedures
- ENERGEX will from time to time email a notice to you when changes
to Standard Work Procedures have been posted to SWP Online.
- Notice of a change will be deemed to be received by you within
one business day of sending by ENERGEX.
- Upon receiving the notification of a change, you must access the
changed Standard Work Procedures at SWP Online and communicate the
changes to all persons or operators performing work for or on a Service
Provider's
behalf, within 5 working days.
- ENERGEX may monitor and record access by you to SWP Online
to ensure Service Providers:
- access changed Standard Work Procedures and reference
documents in a timely fashion; and
- are aware of and perform work in accordance with changes to the
Standard Work Procedures.
- The Service Provider must perform all work (including any work
in progress at the time of the change to a Standard Work Procedure)
in accordance with the most current version of the applicable Standard
Work
Procedure.
- ENERGEX cannot guarantee a notice (as described in paragraph 10)
is received by you. You agree that you will access SWP Online at
least every 21 days to see if there has been any change to the Standard
Work
Procedures.
Intellectual Property
- The inclusion of a link to a site outside of SWP Online is not
an endorsement or a recommendation by ENERGEX.
- You agree that you do not acquire any intellectual property
rights in SWP Online or any of its contents. Other than reading and
printing for ENERGEX related purposes, you will not exercise any
intellectual property right in respect of SWP Online or the content
on SWP Online.
Privacy
- ENERGEX is committed to privacy. This is a link to the ENERGEX
Privacy Policy setting out how ENERGEX deals with personal information generally.
- In addition to this policy, in order to allow you to have access
to SWP Online, ENERGEX may ask you or your Service Provider to submit
information, which for example, may include but not be limited to,
the company name, authorised representative name, address, telephone
number and e-mail address.
- You must ensure that the information that you provide to ENERGEX
is and remains current, correct and complete at all times.
- If you provides inaccurate or misleading information, or choose
to withhold information, ENERGEX may not be able to provide you with
access to SWP Online and other references that the Service Provider
may require to carry out the relevant services it has contracted to
ENERGEX to provide.
Definitions
"Conditions" means these terms and conditions.
"ENERGEX" means ENERGEX Limited and its related bodies corporate.
"Service Provider" means a person or organisation which is
contracted to ENERGEX to provide services, has pre-qualified to be a service
provider to ENERGEX or is otherwise defined as a Service Provider in the
Standard Work Procedures.
"Standard Work Procedures" includes the documents referenced
by that term in the relevant Service Provider's contract with ENERGEX,
or documents referenced by that term in the Quality Assurance Requirements
for Suppliers of Services document (Issue No 7) and any other document
produced by ENERGEX that describes the extent of work, work procedures,
resources and certification for a particular category of work to be carried
out for ENERGEX.
"Subscriber" means the person who is the authorised representative
of the Service Provider who will access SWP Online.
"You" or "Your" means a reference to each Service
Provider and that Service Provider's associated Subscribers separately
and jointly.
